Bitcoin Fork, Ravencoin Records Slew of Exchange Listings; Kraken Settles With SEC After Facing Charges

Kraken Charged and Settled With SEC

The united states securities and exchange commission (SEC) has announced that it had charged Kraken crypto exchange: ”Today we charged Kraken with failing to register the offer and sale of their crypto-asset staking-as-a-service program, whereby investors transfer crypto assets to Kraken for staking in exchange for advertised annual investment returns of as much as 21 percent.”

It added, “Two Kraken entities, Payward Ventures Inc and Payward Trading Ltd, agreed to immediately cease offering or selling securities through crypto asset staking services or staking programs and pay $30 million in disgorgement, interest, and penalties.”

The news was also announced by SEC chair Gary Gensler, “Today SECGov charged Kraken for the unregistered offer and sale of securities thru its staking-as-a-service program. Whether through staking-as-a-service, lending, or other means, crypto intermediaries must provide the proper disclosures & safeguards required by our laws.”

The Howey Test, which was established by the U.S. Supreme Court in a case that occurred decades ago and is frequently used as a yardstick for determining whether something can be classified as a security under U.S law, may be satisfied, according to SEC Chair Gary Gensler, if staking is made through intermediaries like Kraken.

Under its staking umbrella, Kraken provides several services, one of which is a cryptocurrency lending product with up to 24% yield. this is likewise anticipated to cease operations under the settlement.

According to its website, Kraken’s staking service provided a 20% APY and guaranteed to deliver users staking rewards twice weekly.

On Wednesday, Bloomberg stated that Kraken and the SEC were close to settling on offering unregistered securities.
